Updated: Convicted Murderer Christopher North Denied Re-Hearing for Appeal

A man convicted of murdering another man during a road rage incident in 2011 has been denied a rehearing on his motion to overturn the trial court’s sentence.

Christopher North was sentenced to 70 years in prison back in 2011 for shooting and killing another man, Austin David, during an altercation that occurred at the intersection of Sayles and South 14th.

Witnesses testified in the trial that North sped around David as they approached the intersection, prompting David to make a gesture toward North as he passed.

According to witnesses, North then got out of his car in a threatening manner and advanced toward David, who got out of his car holding a gun, which he pointed at North. Both men returned to their cards after an argument. Witnesses further testified that North then reversed his vehicle and backed into David’s car while David had on his breaks and, after the cars had come to a stop, exited his vehicle with a gun and shot David before David could fully get out of his vehicle.

North was denied an appeal for a retrial on January 24th of this year by the 11th Court of Appeals. The request to overturn the trial court’s sentence was based on the defense position that the jury instructions focused only on David’s viewpoint of the encounter and left out instructions related to the possibility that North may have acted in self defense. North was denied a rehearing on this matter by that court.

North has subsequently filed a Petition for Discretionary Review in the Court of Criminal Appeals.

For now, North remains in a Huntsville prison unit.


Correction: On Monday July 21, 2014 this story was corrected to include attribution on certain statements made by witnesses in court, as well as retract an incorrect statement that North had been ‘denied’ his second appeal. North has only been denied a rehearing on his original appeal. On July 10, 2014, North filed for review by the Court of Criminal Appeals.
