A pre-trial hearing took place today for a man who allegedly shot a then 17-year-old in the back in early February 2012.

In early 2012, 21-year-old Michael K Higgins was indicted on charges of aggravated robbery and aggravated assault with a deadly weapon for allegedly shooting then 17-year-old Lloyd Shelton III, who, according to his family, was then paralyzed from the chest down.

According to the arrest warrant, Higgins told police after his arrest that he had enlisted three others also indicted in the case on robbery charges—now 19-year-old Hailey Morgan Patterson, 21-year-old Jon Michael Patterson and 21-year-old James Miller—to lure Shelton into a residence on the 800 block of Sammons Street so Higgins could fight him.

The plan then devolved into robbing Shelton of his drugs and money and then, as Shelton tried to run away, Higgins allegedly shot him in the back.

The pre-trial hearing was held to determine whether or not Higgins’ statements to the police would be admissible during his trial. The judge determined Wednesday that they were not.
